Appearing in the Landlord and Tenant Board

The Landlord and Tenant Board, deals with conflicts between the Landlords and Tenants. As simple as a conflict may seem, the process to have your matter heard can be frustrating and confusing. At Certificates Express we assist with making the procedure and the process of being heard in court much easier.

The Landloard and Tenant Board is known as a “quasi-judicial” agency. “Quasi-judicial” refers to an entity that is not necessary a court but “almost” like a court.

The Board follows the rights and responsibilities of the Residential Tenancies Act (the RTA). The RTA gives residential landlords and tenants specific rights and responsibilities, and sets out a process for how these rights and responsibilities can be enforced. The RTA also has certain rules governing rent increases for residential rental accommodation, and gives the Board authority to enforce these rules.

The role of the Board is to:

resolve disputes between landlords and tenants through either mediation or adjudication,
regulate rent increases in most residential rental units, and
educate landlords and tenants about their rights and responsibilities under the Residential Tenancies Act.

How We Work

We understand that landlord and tenant matters that are heard by the Board, do not require representation (e.g. a lawyer or paralegal). We understand that individuals can represent themselves before the Board. We also understand that the practice and process can be tedious and confusing. Therefore, our service strives to ease all anxiety and assist in making the legal matter heard in an efficient and effective way. To help you achieve your desired legal results.

We will complete all the required documentation; required when appearing before the Board and if necessary, we will provide you with the proper legal representation during the mediation and hearing processes.

Consultations

Your first contact with us will be during our consultation with you, at this point you will explain your matter to our experienced team. During the consultation, we will provide you with advice on the different legal options that can be taken, and we will offer you our services. Once you have decided on our services, we will ask you to fill out a retainer and to provide us with proper identification.

Our Service

If a claim is or is to be filed with the Board, we will assist you with completing all the documentation required regarding your matter. We will prepare you with all the information that is required in preparation for hearing.

All your documents will be filled, and we will provide you with a brief report with suggestions that may assist you during mediation and/or hearing.

If you do not feel confident in representing yourself, we have licensed paralegals that can represent you during mediation and/or hearing. The cost of representation depends on the legal matter and the amount of preparation that is required for the case.

Please keep in mind that our legal services are only provided for Ontario residences. Unfortunately, we are unable to provide legal services outside of Ontario at this time.
